The legal crisis that has trailed the conduct of the primaries conducted by the Peoples Democratic Party, PDP came up today for hearing.
Earlier today, January 21, 2023, the Supreme Court of Nigeria dismissed one of the Appeals filed by Ferdinand Orbih SAN and Nurudden SAN on behalf of Ogbeide-lhama & Ors v. Hon. Matthew Iduoriyekemwen & Ors Appeal No. SC/CV/1615/2022.
In dismissing the Appeal, the court referred to it as ‘multiplicity and waste of court time’.
The Appellants lawyer, thereafter requested leave of court to fill additional pleadings. The court granted his request and adjourned the case to January 26, 2023 to decide the fate of the three Appeals that survived.
The court gave reason that, the appeal that was dismissed was filed without the consent of one Appellant.
When the case was called, a mild drama erupted when a lawyer appeared for the 16th Respondent, seeking leave of the Court to withdraw the Appeal, as it was filed without the consent of the 16th Appellant.
Counsel for the 16th Appellant informed the court that he had filled a Notice of Withdrawal of the Appeal, because it was filed without the consent of the 16th Appellant.
On the strength of his argument, the court dismissed one of the Appeals.
